Welcome to Something New Design Studio. By using this website or purchasing services or digital products from Something New Design Studio, you agree to the following Terms & Conditions.
The Short Version
This is a plain-language summary so you actually know what you're agreeing to. The full terms below are the ones that legally apply.
Payment. Payment reserves your date. Design service payments are non-refundable. If you're on a payment plan, all payments need to be complete before your Design Day begins.
Rescheduling. Life happens! Give me at least 7 days' notice and we'll find a new date. Inside 7 days, or if your prep materials don't come in on time, there's a $500 rescheduling fee.
Your part. You provide your copy, photos, and any existing brand materials, and you confirm you have the right to use them. You also review and approve everything before it goes live.
No AI, please. I want your real voice in your questionnaire and your real gut reaction to the designs, even if it's messy. I don't work from AI-generated logos or images either. More on why in Section 10.
Ownership. Once you've paid in full, the final designs are yours. Unused concepts and working files stay with me. Fonts are licensed separately and that part is on you, but I'll always tell you exactly what I used and where to get it.
Digital products. Templates and workshops are licensed for you and your practice. Please don't resell or share them.
Websites. I build on Wix. Hosting, domain, and subscription costs are paid directly to Wix and are separate from my fee. After handoff, the site is yours to maintain.
Results. I design with strategy, accessibility, and SEO in mind, but I can't promise specific rankings, traffic, or new patients. No designer honestly can.
Your work in my portfolio. I may share completed projects on my site and social media. If you'd rather I didn't, just tell me in writing before we finish.
Being decent to each other. I reserve the right to end a project if communication becomes abusive or disrespectful. I've never had to use this, and I hope I never do.

1. Design Services
Something New Design Studio provides branding, website design, strategy sessions, and other creative services as described on this website or in your individual service agreement.
Design Day Intensives are time-based services. Work is prioritized based on the goals and priorities discussed before the scheduled Design Day. Because each Design Day is limited to one focused day, not every requested item is guaranteed to be completed. Additional work may require an additional Design Day or separate quote.
Your individual service agreement or invoice may include additional terms specific to your project.
2. Payments & Refunds
Payment is required to reserve a Design Day or service date.
Payments for design services are non-refundable. If a payment plan is selected, all scheduled payments remain due according to the agreed payment schedule.
All scheduled payments must be completed before the Design Day begins. If a payment plan is not fully paid by that date, the Design Day may be rescheduled and a rescheduling fee may apply.
Digital products are non-refundable once purchased and delivered, except where required by applicable law.
Invoices unpaid after 30 days may be subject to a 2% late fee, as outlined in the applicable service agreement or invoice.
3. Rescheduling
Design Days may be rescheduled with at least 7 days' notice, subject to availability.
Rescheduling requests made within 7 days of the scheduled Design Day may be subject to a $500 rescheduling fee and will be moved to the next available date.
If required client materials are not submitted by the agreed deadline, Something New Design Studio may also need to reschedule the project. A $500 rescheduling fee may apply.
4. Strategy Sessions
Strategy Sessions are scheduled appointments and payment is due at the time of booking.
Strategy Sessions may be rescheduled with at least 48 hours' notice, subject to availability.
Missed appointments, no-shows, and cancellations made with less than 48 hours' notice are non-refundable and will not be rescheduled.
Strategy Sessions are advisory only. They do not include design work, written deliverables, revisions, or implementation, and they do not reserve or guarantee a Design Day date.
5. Client Responsibilities
Clients are responsible for providing accurate and timely information, including website copy, photographs, logos, brand materials, and other content needed for their project.
Clients are responsible for ensuring they have the legal right to use any text, photographs, logos, fonts, or other materials they provide.
Something New Design Studio is not responsible for claims resulting from materials supplied by the client.
Clients are also responsible for reviewing and approving their final designs and website content before launch or delivery.
6. Ownership & Licensing
Once a design project has been paid in full, the client owns the final, approved design assets created specifically for their project.
Unused concepts, preliminary designs, and working files remain the property of Something New Design Studio.
Font licensing is the responsibility of the client. If a font requires a separate license for use on a website, in Canva, or in other software, the client is responsible for purchasing that license. Something New Design Studio will provide font names and sources when applicable.
7. Digital Product License
Digital products, including templates, template bundles, social media kits, and workshops, are licensed for use by one individual or one practice.
Digital products may be customized and used for the purchaser's own practice. They may not be resold, redistributed, shared, transferred, sublicensed, or used to create products or templates for resale.
Purchasing a digital product grants a license to use it. It does not transfer ownership of the underlying designs, templates, or materials, which remain the property of Something New Design Studio.
Access may be revoked without refund if these license terms are violated.
8. Websites & Wix
Websites created by Something New Design Studio are built using Wix.
Clients are responsible for all Wix-related costs, including hosting, domain registration, subscription plans, and premium features. These costs are paid directly to Wix and are separate from design fees.
Once the website has been completed and transferred, the client is responsible for maintaining their Wix account, subscription, domain, and ongoing website content unless additional services are purchased.
Something New Design Studio is not responsible for changes to Wix pricing, features, policies, functionality, or availability.
9. Website Accessibility
Something New Design Studio aims to create websites that are user-friendly and accessible to as many people as possible. Website designs are created with accessibility best practices in mind, including considerations such as readable typography, color contrast, clear navigation, descriptive links, and mobile responsiveness when applicable.
However, accessibility can depend on the website platform, third-party tools, plugins, content, and ongoing changes made to the website after completion. Something New Design Studio does not guarantee that a website will meet every accessibility standard, guideline, or legal requirement.
The client is responsible for maintaining accessibility when making changes to their website after the project is completed, including adding new content, images, links, forms, or third-party integrations.
Clients who have specific accessibility requirements or need their website to meet a particular legal or industry standard should communicate those requirements before the project begins and may need to obtain an accessibility audit or consultation from a qualified accessibility professional.
10. Creative Direction & AI
Something New Design Studio creates original designs based on the client's goals, preferences, and inspiration.
AI-generated materials are not used as a starting point for design work. Something New Design Studio does not recreate, trace, redraw, or build from AI-generated logos, illustrations, or design concepts. AI-generated logos carry no copyright or trademark ownership, no vector files, and no documented fonts or color values, which means there is nothing a client can legally own or build a brand on.
Client communication should be in the client's own words. The design process depends on hearing how a client actually talks about their practice and how they genuinely react to a design. Questionnaire responses, project communication, and design feedback should be written by the client rather than generated by AI. Imperfect, unpolished answers are welcome and preferred.
Something New Design Studio reserves the right to request that questionnaire responses or feedback be resubmitted in the client's own words, and reserves the right to pause a project until that is provided.
Something New Design Studio reserves the right to use professional creative judgment regarding design, layout, typography, color, accessibility, and overall brand direction.
11. Portfolio & Promotional Use
Something New Design Studio may display completed branding and website projects in its portfolio, website, social media, and other marketing materials.
If a client needs their project to remain private, they must request this in writing before project completion.
12. Limitation of Liability
Something New Design Studio provides professional design services but does not guarantee specific business results, including increased website traffic, inquiries, clients, revenue, or sales.
To the fullest extent permitted by law, Something New Design Studio will not be responsible for indirect or consequential damages resulting from the use of its services, websites, or design materials.
Something New Design Studio's total liability related to a project will not exceed the amount paid by the client for that project.
13. SEO
Basic SEO setup may be included with website services, such as page titles, descriptions, and website structure.
Something New Design Studio does not guarantee specific search engine rankings, website traffic, inquiries, or other business results. SEO performance depends on many factors outside of the Designer's control, including search engine algorithms, competition, website content, and ongoing optimization.
14. Professional Conduct
Something New Design Studio reserves the right to pause or terminate a project if communication becomes abusive, threatening, disrespectful, or consistently unprofessional.
If a project is terminated for this reason, payments already made will not be refunded.
15. Changes to These Terms
Something New Design Studio may update these Terms & Conditions from time to time. The most current version will be posted on this website with the updated date.
16. Governing Law
These Terms & Conditions are governed by the laws of the State of Illinois, without regard to conflict of law principles.
